Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the DutyWire mobile applications, websites, including dutywire.com, and related services (collectively, the “Services”) provided by DutyWire Technologies LLC (“DutyWire,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

These Terms apply to individual users of the public DutyWire app. They do not create or constitute a system-of-record agreement, agency software agreement, public safety software agreement, records-management agreement, evidence-management agreement, dispatch agreement, or official workplace agreement for any agency, employer, department, union, municipality, company, or other organization.

1. eligibility

You can only use the Services if:

- You are at least 13 years old, or meet the minimum age specified by your local laws.

- You have the legal ability to agree to these Terms.

- Your use of the Services complies with applicable laws and rules from your workplace, agency, employer, or organization.

- If you are acting for someone else or an entity, you confirm you are authorized and agree to these Terms on their behalf.

2. Accounts and Security

You are responsible for safeguarding your account credentials and all activities under your account.

You must provide accurate information, keep it reasonably updated, and notify us immediately at support@dutywire.com if you suspect unauthorized access.

If you use features like “Remember me,” saved login, biometric, or passkey, your device or platform may store authentication tokens. You are responsible for securing your device. DutyWire is not liable for unauthorized access due to lost, stolen, compromised, shared, or insecure devices, or credential misuse.

3. Purpose of the Services

DutyWire is designed for personal organization, planning, recall, and productivity. It helps users manage schedules, shared calendars, tasks, reminders, shift activities, fitness, financial planning, records, traffic code references, and related data.

DutyWire is not:

- An official police, fire, EMS, dispatch, corrections, healthcare, government, employer, or agency system.

- A computer-aided dispatch system.

- An agency records-management system.

- An evidence-management system.

- A legal research platform.

- A legal, medical, financial, tactical, emergency, employment, or public safety advisory service.

- A replacement for official reports, records, training, agency policies, supervisor instructions, court rules, legal counsel, medical or financial professionals, or emergency services.

You are responsible for determining if information entered into DutyWire also needs to be documented, retained, reported, disclosed, or stored in an official system.

4. Personal Shift Logs, Fire Logs, Tasks, Notes, and Records

DutyWire may include features like Shift Log, Fire Log, Duty Tasks, Records, documents, notes, files, photos, certifications, PDFs, and other recall tools. These are meant for personal organization only.

You agree not to use DutyWire as:

- An official incident report.

- An arrest report.

- An evidence log.

- A dispatch record.

- An agency-approved records system.

- A medical record.

- A legally required retention system.

- A substitute for workplace reporting, documentation, or chain-of-command procedures.

Do not enter highly sensitive, regulated, classified, evidentiary, confidential, protected, or official information unless you are certain you have permission, a lawful reason, and authority to do so.

This includes, but is not limited to, CJIS-protected data, HIPAA-regulated details, medical or victim information, suspect or juvenile data, confidential informant info, sealed records, case numbers, addresses, protected personal data, agency-sensitive info, or any content that should only be stored in a secure official system.

You are responsible for complying with workplace policies, public records laws, discovery obligations, retention requirements, evidence protocols, privacy regulations, and all relevant laws and policies.

5. Ask DutyWire AI

DutyWire offers AI-powered features, including Ask DutyWire AI, which helps users inquire about their schedule, calendar events, tasks, traffic code references, daily planning, and other content supported by DutyWire.

This AI feature is intended for convenience and personal productivity. Responses generated may be incomplete, inaccurate, outdated, misunderstood, or inappropriate for your specific situation. They may not reflect current laws, agency policies, court interpretations, employer rules, official guidance, or professional standards.

You are responsible for independently verifying all AI responses before relying on them. For matters related to traffic codes, legal issues, employment, policy, public safety, medical, financial, operational, or official matters, consult official sources, agency policies, supervisors, legal professionals, courts, or qualified experts.

You agree not to use Ask DutyWire AI for:

- Emergency responses

- Dispatch decisions

- Life-safety decisions

- Probable cause assessments

- Charging decisions

- Legal compliance

- Official report writing

- Evidence preservation

- Medical decisions

- Tactical or employment discipline decisions

- Any decision where inaccurate info could cause legal, safety, employment, financial, medical, or operational harm

Avoid entering sensitive, confidential, protected, regulated, official, evidentiary, or personal information unless you are certain you have permission and a lawful reason.

Ask DutyWire AI may have usage limits, quotas, or be unavailable at times. DutyWire can change, suspend, or remove AI features at any time, in accordance with applicable laws and app store policies.

6. Traffic Code References and State Packs

DutyWire offers tools like traffic code lookup, installed statute packs, state or jurisdiction-specific packs, reference cards, citation details, summaries, categories, search functions, and AI-driven traffic code responses.

The traffic code content is intended solely for general reference, personal study, and individual use. It does not constitute legal advice, official legal authority, court guidance, agency policies, training certification, or a replacement for official statutes, regulations, case law, agency directives, prosecutor guidance, court rules, legal counsel, or supervisor instructions.

Traffic laws, fines, penalties, points, surcharges, procedures, titles, code sections, and interpretations are subject to change. The information provided might be incomplete, outdated, inaccurate, unavailable, or restricted by the installed pack, free preview limits, subscription level, or jurisdiction.

It is your responsibility to verify all traffic code details with official sources before relying on them. DutyWire disclaims liability for citations, enforcement actions, court decisions, legal consequences, employment issues, or any actions based on the traffic code information available through the Services.

If a traffic code pack is not installed or accessible for a jurisdiction, DutyWire may show limited information or notify that no pack is downloaded.

7. Calendar, Schedule, and Shared Calendar Features

DutyWire may permit users to create various calendars, rotating schedules, shared calendars, work and personal events, family activities, reminders, overtime entries, vacations, training sessions, court dates, appointments, and related schedules.

Users are responsible for ensuring the accuracy of all schedules, dates, times, time zones, reminders, recurring patterns, shift templates, and sharing permissions.

The service does not guarantee that calendar data, reminders, notifications, shared updates, time zone calculations, rotation patterns, or synchronization will always be accurate, current, available, or timely.

Depending on permissions and feature behavior, shared calendar members may be able to view, add, modify, or retain content. Content shared may remain visible even if you later edit, leave, revoke access, delete the app, or delete your account.

8. Notifications, Reminders, and Shift Prompts

DutyWire may send local alerts, push notifications, calendar reminders, shift start and end prompts, setup notifications, subscription notices, shared calendar alerts, and other service-related messages.

These notifications could be delayed, missed, duplicated, inaccurate, or unavailable due to device settings, OS restrictions, battery optimization, network issues, app permissions, app store restrictions, or third-party problems.

You are responsible for managing your schedule, attendance, workplace obligations, and reminders. DutyWire is not liable for missed shifts, events, deadlines, late arrivals, overtime mistakes, or any other outcomes resulting from missed or inaccurate notifications.

9. Fitness, Wellness, and Device Data

DutyWire may include features related to fitness, wellness, workouts, body statistics, planning tools, progress tracking, and integrations with Apple Health, Health Connect, and other supported devices.

These features are intended for personal tracking and convenience only. DutyWire does not offer medical, health, fitness, nutrition, mental health, injury prevention, or safety advice.

Consult qualified professionals before making decisions about health, fitness, wellness, nutrition, or safety.

If you connect Apple Health, Health Connect, or other supported devices or data sources, you are responsible for managing permissions. Data such as health metrics, activity details, heart rate, calories, distance, body information, and similar data may be incomplete, delayed, inaccurate, duplicated, unavailable, or affected by device settings, platform limits, or third-party apps.

Do not rely on DutyWire for emergency, medical, or life-safety decisions.

10. Money, Budgeting, Overtime, and Financial Tools

DutyWire may feature tools for money management, budgeting, tracking overtime, expenses, savings goals, coverage options, extra income scenarios, retirement countdowns, and related planning.

These are for personal organization and estimation only. DutyWire does not provide financial, tax, investment, retirement, insurance, legal, employment, payroll, or benefits advice.

Calculations are estimates and may not include taxes, deductions, overtime rules, collective bargaining agreements, payroll policies, pension rules, inflation, interest rates, employer practices, or legal changes.

Consult qualified professionals before making financial, tax, retirement, legal, employment, or benefits decisions.

11. Voice Shortcuts, Assistant Actions, and Deep Links

DutyWire may support Siri, App Shortcuts, Android shortcuts, deep links, widgets, quick actions, or similar features for convenience.

Use these features responsibly. Review any entries, actions, notes, or logs created via voice shortcuts, assistant commands, or deep links.

DutyWire is not responsible for misunderstandings, speech recognition errors, accidental activations, duplicate entries, missing data, or incorrect information. Ensure you review information before relying on it.

Platform providers like Apple and Google process voice input and activity according to their own privacy policies.

12. User Content

“User Content” includes information, files, schedules, events, reminders, notes, logs, documents, photos, records, tasks, prompts, messages, shared calendar items, and other data you create or upload using the services.

You keep ownership of your User Content. You grant DutyWire a limited, non-exclusive, worldwide, royalty-free license to host, store, process, display, reproduce, transmit, and use your content as needed for operating and supporting the services.

Local-only features may not transmit data to DutyWire. You are responsible for your data and ensure it complies with laws, rights, policies, and confidentiality obligations.

You are solely responsible for the legality and appropriateness of your User Content. DutyWire may remove or restrict content if it breaches these Terms, creates risk, is legally required, or necessary for security or operation.

13. Privacy

Your use of the Services is also subject to our Privacy Policy, which can be viewed at:

Ask DutyWire AI and related features may process prompts, questions, and app context to generate responses, following the Privacy Policy and service provider terms.

Do not submit sensitive, regulated, official, confidential, evidentiary, medical, or protected information unless you are certain you have permission and a lawful basis.

14. App Store Terms

If you download DutyWire via the Apple App Store, Apple’s terms apply. For downloads through Google Play, Google’s terms apply.

These Terms govern your use of DutyWire and supplement, but do not replace, the store’s terms.

Apple and Google are not responsible for DutyWire support or maintenance, unless required by their terms.

15. Subscriptions, Billing, Trials, and Refunds

DutyWire offers free and paid features, including DutyWire Pro.

Paid features include, but are not limited to, Ask DutyWire AI, increased AI usage limits, traffic code lookup, expanded code access, additional jurisdiction packs, money tools, fitness tools, records, shared calendar, customization, and other tools.

Subscriptions are billed through the relevant app store—Apple or Google. DutyWire does not handle your full payment card info.

Subscriptions renew automatically unless canceled before renewal, as per store rules.

Manage or cancel subscriptions via your Apple ID or Google Play settings. Deleting your account or app does not cancel your subscription.

Refunds are managed by the app store based on their policies. DutyWire does not control refund decisions.

Pricing, features, trials, promotions, quotas, limits, and benefits may change over time, according to laws and store rules.

16. Acceptable Use

You agree not to:

- Use the Services unlawfully, fraudulently, harmfully, abusively, or deceptively.

- Harass, threaten, impersonate, defame, or harm others.

- Store, process, or share official, confidential, sensitive, or regulated info illegally.

- Use the Services for emergency dispatch, life-safety, official reporting, or workplace operations unless explicitly allowed.

- Interfere with, disrupt, reverse engineer, scrape, copy, modify, resell, or misuse the Services.

- Bypass limits or security controls.

- Upload malware, unauthorized content, or rights-infringing material.

17. No Professional Advice or Emergency Use

DutyWire does not offer medical, legal, financial, or other professional advice.

It is not an emergency service. Do not rely on DutyWire for dispatch, emergencies, or urgent decisions.

In emergencies, contact official emergency channels.

18. Third-Party Services and Links

The Services may connect to or include third-party services, platforms, content, websites, or infrastructure providers such as app stores, payment processors, cloud providers, AI services, notification tools, analytics, crash reporting, weather data, map or location services, Apple Health, Health Connect, and other device platforms.

DutyWire is not responsible for third-party products, services, websites, content, data, platform choices, outages, app store decisions, refunds, AI provider availability, voice recognition accuracy, health data access, or third-party policies.

Your use of third-party services is governed by their own terms and privacy policies.

19. Intellectual Property

The Services—including the app, website, software, design, branding, logos, icons, text, graphics, features, workflows, and other materials—are owned by DutyWire or its licensors and protected by intellectual property laws.

Under these Terms, DutyWire grants you a limited, non-exclusive, non-transferable, revocable license to install and use the app on your personal devices for non-commercial purposes.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or try to extract source code from the Services unless law allows it.

20. Feedback

By providing feedback, suggestions, ideas, bug reports, feature requests, reviews, or other comments, you grant DutyWire the right to use this information freely and without obligation or compensation.

21. Service Changes

We may modify, suspend, discontinue, update, remove, or limit all or part of the Services at any time, with or without notice, in compliance with applicable laws.

We are not responsible for any changes, interruptions, suspensions, deletions, or discontinuations of the Services or its features.

22. Terms Updates

These Terms may change periodically. When they do, we will update the “Last updated” date and may notify you of major changes.

Continuing to use the Services after updates means you accept the new Terms.

23. Termination

We may suspend or terminate your access if:

- You breach these Terms.

- Your use poses legal, security, support, reputation, operational, or platform risks.

- We discontinue the Services or part of them.

- Required by law, app store rules, platform rules, or third-party service providers.

You can stop using the Services anytime and request account deletion via the app or support@dutywire.com.

Upon termination, your access ends. We may delete, restrict, or keep content and data as described here and in our Privacy Policy. Provisions that should survive termination—including ownership, disclaimers, liability limits, indemnity, privacy obligations, and enforcement—will remain in effect.

24. Account Deletion and Data Retention

You can delete your account through the app by navigating to:

Profile > Settings > Delete Account

Alternatively, contact support@dutywire.com for help.

When you delete your account:

- Your authentication account will be removed.

- Certain cloud-based data will be deleted or deactivated from active systems within a reasonable timeframe, depending on legal, security, backup, fraud prevention, and operational needs.

- Shared calendar content already visible to other members may not be removed.

- Subscriptions will not be automatically canceled.

- Local data stored only on your devices will not be deleted automatically.

- Backup copies, logs, purchase and support records, and security data may remain temporarily as detailed in the Privacy Policy or by law.

25. Disclaimers

The services are provided 'AS IS” and “AS AVAILABLE'.

To the maximum extent allowed by law, DutyWire disclaims all warranties, including implied warranties of merchantability, fitness for a specific purpose, non-infringement, availability, accuracy, security, and error-free operation.

We do not guarantee:

- The services will always be accessible.

- The services will be secure, stable, or error-free.

- Data will never be lost, delayed, corrupted, duplicated, inaccurate, or unavailable.

- AI responses will be always accurate, complete, and current.

- Traffic code references will always be complete, up-to-date, legally binding, or relevant.

- Calendar data, reminders, notifications, schedules, shift prompts, shared updates, voice commands, shortcuts, health info, weather data, or device-specific features will always function.

- Third-party services, app stores, AI providers, payment processors, notification services, health data providers, or weather services will remain available and accurate.

26. Limitation of Liability

To the maximum extent allowed by law, DutyWire and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be responsible for any indirect, incidental, special, consequential, exemplary, or punitive damages. This includes any loss of profits, revenue, business, goodwill, data, content, subscriptions, records, health information, reminders, notifications, schedules, traffic code information, AI responses, or use that arise from or relate to the Services or these Terms.

DutyWire’s total liability for any claim related to the Services or these Terms will not exceed the greater of:

- The amount you paid to DutyWire or via the respective app store for the Services during the 12 months before the claim arose, or

- USD $100.

Please note that some jurisdictions may not allow certain liability limitations, so some restrictions may not apply to you.

27. Indemnification

You agree to defend, indemnify, and hold harmless DutyWire and its affiliates, owners, officers, employees, contractors, licensors, and service providers against all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, that result from or are related to:

- Your use of the Services,

- Your User Content,

- Your breach of these Terms,

- Your violation of any law, workplace rule, agency policy, contract, confidentiality obligation, or third-party rights,

- Your use of DutyWire for official, regulated, emergency, evidentiary, medical, legal, financial, operational, or professional purposes contrary to these Terms.

28. Consumer Rights

Nothing in these Terms limits any rights you may have under applicable consumer protection laws that cannot be waived.

29. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules, unless otherwise required by law. If you are in a jurisdiction that grants you mandatory local rights, these Terms do not restrict those rights.

30. Copyright and Trademark Complaints

If you believe content in the Services infringes your copyright, trademark, or other rights, contact support@dutywire.com. Please include enough details to identify the material and describe your claim. We may remove or restrict access to infringing content and may terminate repeat infringers as appropriate.

31. Miscellaneous

These Terms, along with the Privacy Policy and any specific feature terms, form the entire agreement between you and DutyWire regarding the Services. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision does not waive our rights. You cannot assign these Terms without our prior written consent, though we may do so in cases of mergers, acquisitions, reorganizations, financing, or asset sales. We are not responsible for delays or failures beyond our reasonable control. Headings are for convenience only and do not affect interpretation.
