Terms of Service

These Terms of Service ("Terms") govern your access to and use of the DutyWire mobile applications, websites, including dutywire.com, and related services (collectively, the "Services") provided by DutyWire Technologies LLC ("DutyWire," "we," "us," or "our").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
These Terms apply to individual users of the public DutyWire app and do not create or constitute a system-of-record agreement for any agency, employer, department, union, municipality, company, or other organization.
1. Eligibility
You may use the Services only if:
· You are at least 13 years old, or the minimum age required by the laws of your country or region.
· You have the legal capacity to enter into these Terms.
· Your use of the Services is permitted by applicable law and any rules that apply to your workplace, agency, employer, department, or organization.
If you use the Services on behalf of another person or entity, you represent and warrant that you are authorized to do so and that you agree to these Terms on their behalf.
2. Account registration and security
Certain features require an account. You agree to:
· Provide accurate, current, and complete information.
· Keep your login credentials confidential.
· Promptly notify us at support@dutywire.com if you suspect unauthorized access to or misuse of your account.
You are responsible for all activity that occurs under your account.
If you enable the "Remember me" feature, your email address and password may be securely stored on your device using iOS Keychain or Android encrypted preferences to help prefill sign-in and streamline access. You may disable this feature at any time. DutyWire is not responsible for unauthorized access caused by loss, theft, compromise, or misuse of your device or credentials.
3. Personal use only; not an official system
The public DutyWire app is intended for personal organization, personal recall, and personal productivity. It helps users organize schedules, tasks, fitness, wellness, money, records, and related information.
DutyWire is not:
· An official employer, agency, department, CAD, RMS, HR, payroll, medical, evidence, public safety, or records system.
· An emergency dispatch, emergency communications, or life-safety service.
· A substitute for official documentation, official agency systems, professional advice, or legal compliance obligations.
You are solely responsible for determining whether information entered into DutyWire must also be entered, retained, reported, preserved, or maintained in an official system.
4. Logs, records, and official-use restrictions
DutyWire includes Shift Log, Fire Log, Duty Tasks, Records, and related recall tools. These features are intended for personal tracking and organization only.
You agree not to use DutyWire as:
· A CAD or RMS replacement.
· An official incident report system.
· An evidence management system.
· A medical record system.
· A personnel, payroll, disciplinary, or HR system.
· A repository for classified, CJIS-protected, HIPAA-regulated, or other highly regulated data unless DutyWire expressly provides a separate written agreement covering that use.
Do not enter names, addresses, case numbers, medical details, protected information, or sensitive official identifiers unless you are certain you have permission and a lawful basis to do so. You remain responsible for complying with workplace policies, public records rules, retention obligations, discovery obligations, evidence rules, and all applicable laws.
5. License
Subject to these Terms, DutyWire grants you a limited, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control for your personal, non-commercial use.
You may not:
· Copy, modify, adapt, or create derivative works of the Services except as permitted by applicable law.
· Reverse engineer, decompile, or attempt to extract source code from the Services except where prohibited by applicable law.
· Rent, lease, sublicense, resell, or transfer the Services.
· Bypass, disable, or interfere with security-related features.
· Use the Services in any unauthorized, abusive, harmful, or unlawful manner.
6. App store terms
If you download the iOS version of DutyWire through the Apple App Store, Apple's standard Licensed Application End User License Agreement applies to the app license. These Terms govern your use of the DutyWire Services and supplement, but do not replace, Apple's standard terms where applicable.
If you download the Android version of DutyWire through Google Play, Google Play's applicable terms also apply. These Terms govern your use of the DutyWire Services and supplement, but do not replace, Google Play's terms where applicable.
Apple and Google are not responsible for providing support or maintenance for the DutyWire Services except as required by their own applicable terms.
7. Subscriptions, billing, and refunds
7.1 Billing
Subscriptions are billed through the applicable app store, including Apple App Store or Google Play. DutyWire does not collect or store your full payment card information.
7.2 Auto-renewal
Subscriptions automatically renew unless canceled before the renewal date. By purchasing a subscription, you authorize the applicable app store to charge recurring fees and any applicable taxes.
7.3 Managing subscriptions
You may manage or cancel your subscription through your Apple ID subscription settings or Google Play subscription settings, depending on where you subscribed. Unless otherwise stated by the applicable app store, cancellation takes effect at the end of the current billing period.
Deleting your DutyWire account or deleting the app does not automatically cancel your subscription.
7.4 Refunds
Refunds are handled by the applicable app store in accordance with its policies. DutyWire does not control app store refund decisions.
7.5 Price changes, trials, and promotions
Subscription pricing, trials, discounts, and promotional offers may change. If a free trial or promotional period applies, it may automatically convert to a paid subscription unless canceled before renewal, subject to app store rules and disclosures.
7.6 Pro features and limits
DutyWire Pro may expand or unlock features such as:
· Additional calendars
· Shared calendar editing
· Advanced shift stamping and recurring scheduling
· Increased records storage, folder capacity, entry capacity, or attachment capacity
· Additional budgeting tools, savings goals, or export features
· Expanded workout, history, routine, or metrics features
· Other premium features added over time
Features, limits, pricing, free-plan allowances, and availability may change over time, subject to applicable law and app store requirements.
8. User content and data handling
8.1 Ownership
You retain ownership of the content you submit, store, create, upload, or share through the Services ("User Content"), including:
· Calendars and events
· Shift stamps
· Recurring shift series
· Repeat and rotation schedule settings
· Shared calendar profiles or family names
· Record folders, entries, notes, and attachments
· Reminders
· Shift Log and Fire Log entries
· Duty Tasks and quick notes
· Wellness entries
· Budgets and goals
· Workout routines and related content
· Fitness, body stat, and activity information
8.2 License to operate the Services
You grant DutyWire a limited, non-exclusive, worldwide, royalty-free license to host, store, process, display, reproduce, and use your User Content solely as necessary to operate, maintain, secure, support, and improve the Services.
For local-only features, DutyWire may not receive or host that data in the current version, but the same responsibility rules still apply to your use of the app and any data you choose to create, store, export, copy, share, or preserve.
8.3 Duration
This license ends when your User Content is deleted from the Services, except where continued retention or access is reasonably necessary to:
· Operate shared features.
· Maintain backups for a limited period.
· Comply with legal obligations.
· Investigate security, support, fraud, or abuse issues.
· Enforce these Terms.
8.4 Shared content
Content shared through shared calendars may remain visible to other members of those calendars, subject to ownership, permissions, and the structure of the shared feature, even if you later lose access or delete your account.
8.5 Sensitive data
Do not store highly sensitive, regulated, classified, official, or protected data in DutyWire, including PHI, CJIS-protected data, classified material, evidence, victim information, suspect information, confidential informant information, sealed records, protected juvenile information, or any information that must be maintained in an official secure system. DutyWire is not designed for regulated or official recordkeeping.
8.6 Cloud-backed and local data
Certain features are cloud-backed, while others are stored locally on your device.
Cloud-backed data may include:
· Account and profile information
· Calendars
· Calendar events
· Shift stamps
· Recurring shift series and related repeat or rotation schedule metadata
· Shared calendar metadata
· Shared calendar profiles or family-name tags
· Member display names, roles, and invite codes
· Optional invitee email addresses
· Record folders, record entries, and attachments
· Subscription and purchase status
· Push registration data, such as device tokens, installation or endpoint identifiers, and related technical registration details needed to deliver notifications reliably
Local-only data may include:
· Money and budget entries
· Expense categories
· Savings goals
· Budgeting calculator inputs
· Fitness routines, saved workouts, exercise library entries, workout logs, and routine assignments
· Skipped routine dates
· Manual body stats, vitals, custom metrics, and daily check-ins
· Shift Log and Fire Log entries, sessions, notes, summaries, and related preferences
· Duty Tasks and quick notes
· Retirement countdown and planning inputs
· Local preferences and local reminder settings
· Profile photos in the current version
· Local usage counters, such as free-plan usage tracking and in-app review prompt timing
· Temporary local shortcut or deep-link actions until the app processes them
Local-only data remains on your device until you delete it, clear local app data, or delete the app.
8.7 Your responsibility
You are solely responsible for your User Content and for ensuring that it does not violate any law, third-party right, workplace rule, agency policy, or these Terms. We may remove, restrict, or disable access to content that we reasonably believe violates these Terms or applicable law.
9. Health, fitness, and wellness features
DutyWire may include fitness, wellness, workout, body stat, and device-linking features. These features are for personal tracking and convenience only.
DutyWire does not provide medical, health, fitness, nutrition, mental health, or safety advice. You should consult a qualified professional before making health, fitness, wellness, or medical decisions.
If you connect Apple Health or another supported device data source, you are responsible for granting, denying, or revoking the permissions you choose. Health, activity, heart rate, calorie, distance, and similar data may be incomplete, delayed, inaccurate, unavailable, or affected by device settings and platform limitations. Do not rely on DutyWire for emergency, medical, life-safety, or professional health decisions.
10. Location and weather features
DutyWire may provide weather or location-assisted features where available. Weather and location-based information may be incomplete, delayed, inaccurate, or unavailable.
DutyWire is not a weather warning, emergency alert, or life-safety service. You should use official weather, emergency, agency, or public safety sources for critical decisions.
11. Voice shortcuts and assistant actions
DutyWire may support Siri/App Shortcuts, Android shortcuts, assistant-compatible entry points, and deep links for certain actions.
Voice shortcuts and assistant actions are provided for convenience only. You are responsible for reviewing any entry or action created through a shortcut or assistant-compatible command. DutyWire is not responsible for misunderstood commands, accidental activations, platform speech recognition errors, duplicate entries, missing entries, or user failure to review an entry when review is appropriate.
Apple, Google, and other platform providers may process voice input according to their own terms and privacy policies.
12. Information HQ, traffic code, and external content
DutyWire may include Information HQ, traffic code references, training resources, links, summaries, saved articles, or other informational content.
This content is provided for general informational convenience only. It is not legal advice, training certification, policy advice, operational guidance, or a substitute for official sources. Laws, policies, procedures, and standards can change. You are responsible for confirming information with official sources, agency policy, supervisors, legal counsel, courts, or other qualified authorities before relying on it.
External websites, services, and content linked through DutyWire are operated by third parties and are subject to their own terms and privacy policies.
13. Acceptable use
You agree not to:
· Use the Services for unlawful, fraudulent, harmful, abusive, or deceptive purposes.
· Harass, threaten, exploit, or harm others.
· Upload malware, malicious code, or other harmful content.
· Scrape, overload, disrupt, or interfere with the Services.
· Attempt unauthorized access to any account, system, or network.
· Circumvent or test security measures without authorization.
· Impersonate another person or misrepresent your affiliation.
· Upload content you do not have the right to upload.
· Use the Services to store or distribute official, regulated, protected, classified, or sensitive information in a way that violates law, policy, contract, or workplace rules.
· Use the Services for emergency dispatch, life-safety, evidence preservation, official reporting, or regulated recordkeeping unless DutyWire separately provides written terms that expressly allow that use.
14. No emergency or professional advice
DutyWire does not provide medical, legal, financial, mental health, employment, public safety, tactical, operational, or other professional advice.
DutyWire is not an emergency service and must not be relied upon for dispatch, emergency response, life-safety purposes, urgent decision-making, official legal compliance, or professional judgment. In an emergency, use official channels.
15. Third-party services and links
The Services may rely on or link to third-party services, content, platforms, or websites, including infrastructure providers, app stores, notification services, payment processors, device platforms, weather providers, Health data platforms, and external content sources.
DutyWire is not responsible for third-party products, services, websites, data, platform decisions, platform outages, app store decisions, refund decisions, voice recognition results, Health data access decisions, or third-party content. Your use of third-party services is subject to their own terms and privacy policies.
16. Feedback
If you provide feedback, suggestions, ideas, bug reports, or feature requests regarding the Services, you grant DutyWire the right to use that feedback without restriction, compensation, or obligation to you.

Your use of the Services is also governed by our Privacy Policy, available at:
18. Changes to the Services
We may modify, suspend, discontinue, or update all or any part of the Services at any time, with or without notice, subject to applicable law.
Except as required by law, we are not liable for any modification, interruption, suspension, or discontinuation of the Services or any feature.
19. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date and may provide additional notice for material changes.
By continuing to use the Services after updated Terms become effective, you agree to the revised Terms.
20. Termination
We may suspend or terminate your access to the Services if:
· You violate these Terms.
· Your use creates legal, security, support, reputational, or operational risk.
· We discontinue the Services or any portion of them.
· We are required to do so by law, app store rule, platform rule, or third-party service provider requirement.
You may stop using the Services at any time and may request account deletion through the app or by contacting support@dutywire.com.
Upon termination:
· Your right to use the Services immediately ends.
· We may delete, restrict, or preserve content and account data as described in these Terms and the Privacy Policy.
· Any provisions that by their nature should survive termination will remain in effect, including provisions relating to ownership, disclaimers, limitation of liability, indemnification, privacy-related obligations, and enforcement.
21. Disclaimers
The Services are provided on an "AS IS" and "AS AVAILABLE" basis.
To the fullest extent permitted by law, DutyWire disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
We do not guarantee that:
· The Services will always be available.
· The Services will be secure or error-free.
· Data will never be lost, delayed, corrupted, duplicated, unavailable, or inaccurate.
· Information displayed in the Services will be complete, accurate, current, or suitable for official use.
· Notifications, reminders, voice shortcuts, app shortcuts, Health data, weather information, calendar sync, or other platform-dependent features will always work.
· Third-party platforms, app stores, Health data providers, payment providers, notification providers, or weather providers will be available or accurate.
22. Limitation of liability
To the fullest extent permitted by law, DutyWire and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, content, subscriptions, records, health information, reminders, notifications, or use arising out of or relating to the Services or these Terms.
DutyWire's total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of:
· The amount you paid to DutyWire or through the app store for the Services during the 12 months before the event giving rise to the claim.
· USD $100.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
23. Indemnification
You agree to indemnify, defend, and hold harmless DutyWire and its owners, officers, employees, contractors, affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or relating to:
· Your use of the Services.
· Your User Content.
· Your violation of these Terms.
· Your violation of any law, workplace rule, agency policy, contract, or third-party right.
· Your use of DutyWire for official, regulated, emergency, evidentiary, medical, or professional purposes contrary to these Terms.
24. Consumer rights
Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection laws.
25. Account deletion and retention
You may delete your account in the app under:
Profile > Settings > Delete Account
You may also contact support@dutywire.com for assistance.
Deleting your account:
· Removes your authentication account.
· Removes or deactivates certain cloud-backed data from active systems within a reasonable period, subject to legal, security, backup, and operational retention needs.
· Does not necessarily remove shared calendar content already visible to other shared-calendar members.
· Does not automatically cancel subscriptions.
· Does not automatically remove local-only data stored on devices where the app remains installed.
Residual backups and logs may remain for a limited period.
26. Notifications
Push and local notifications are optional and may be used for:
· Calendar reminders.
· Scheduling-related service updates.
· Shared calendar updates.
· Account and subscription notices.
· Other service-related notices you enable or that are necessary to operate the app.
You may manage notifications through your device settings and in-app settings, where available. Notifications may be delayed, missed, duplicated, or unavailable due to device settings, network conditions, platform behavior, or service issues.
27. Copyright and trademark complaints
If you believe content in the Services infringes your copyright, trademark, or other rights, contact:
Please include enough information to identify the material at issue and describe your claim. We may remove or restrict access to content and may terminate repeat infringers where appropriate.
28. Miscellaneous
These Terms, together with the Privacy Policy and any feature-specific terms we provide, constitute the entire agreement between you and DutyWire regarding the Services.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms is not a waiver of that provision.
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, financing, or sale of assets.
We are not liable for delays or failures caused by events beyond our reasonable control.
