DUTYWIRE TERMS OF SERVICE
Last updated: December 3, 2025These Terms of Service (“Terms”) govern your access to and use of the DutyWire mobile applications and websites, including dutywire.com and any related pages (together, the “Services”) provided by DutyWire (“DutyWire,” “we,” “us,” or “our”).
Please read these Terms carefully. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
These Terms apply to individual users of the public DutyWire app. They do not constitute a system-of-record agreement for any agency or employer.
Eligibility
You may use the Services only if you are at least 13 years old (or the minimum age required by the laws of your country) and have the legal capacity to enter into a binding agreement. If you use the Services on behalf of another person or entity, you represent that you are authorized to do so and that you agree to these Terms on their behalf.Account registration and security
To use certain features, you may need to create an account and provide accurate, complete information. You agree to maintain the accuracy of your account information, keep your login credentials confidential, not share your account, and notify us at support@dutywire.com if you suspect unauthorized access. You are responsible for all activity under your account.Personal use only
The public version of DutyWire is for your personal use to organize your schedule, wellness, finances, and notes. It is not intended as your agency’s official record system or a substitute for any official reporting system, CAD, RMS, or HR platform. Do not rely on DutyWire as the sole or official record of any legal, disciplinary, or operational matter.License to use the Services
Subject to these Terms, DutyWire grants you a limited, non-exclusive, non-transferable, revocable license to download and install the app on a device you own or control and to use the Services for your personal, non-commercial use. You may not copy, modify, create derivative works, reverse engineer, rent, lease, sell, sublicense, transfer your rights, or bypass security or access controls.User content and data handling
The Services may allow you to create, upload, or store content such as notes, journal entries, schedules, events, workouts, wellness check-ins, savings goals, financial planning entries, career/training records, and comments (“User Content”). You retain ownership of your User Content. You grant DutyWire a limited, non-exclusive, worldwide, royalty-free license to host, store, process, display, and use your User Content solely as necessary to operate, maintain, and improve the Services.
Cloud storage: We use third-party providers (e.g., cloud hosting) to deliver the Services. We do not guarantee continuous availability or retention; maintain your own backups.
Sensitive/regulated data: Do not store regulated or highly sensitive data (e.g., protected health information, government-classified data). The Services are not designed for regulated or official recordkeeping.
You are responsible for your User Content and ensuring it does not violate law or third-party rights or contain illegal, harmful, threatening, abusive, or objectionable material. We may remove or restrict User Content that violates these Terms or law.
Acceptable use
You agree not to use the Services to engage in unlawful, fraudulent, or malicious activity; harass or harm others; access accounts or data that are not yours; interfere with or disrupt the Services; transmit viruses or harmful code; use automated systems to send excessive requests; or attempt to bypass access controls. We may investigate and suspend or terminate access for violations.No emergency or professional advice
The Services help you organize personal information. They do not provide medical, legal, financial, or other professional advice; do not replace professional judgment; and are not designed for emergency or life-safety use. In emergencies, call your local emergency number or use official channels. Do not rely on DutyWire for emergency communication, dispatch, or time-sensitive operational decisions.Third-party services and links
The Services may contain links to third-party sites or services. We are not responsible for their content, policies, or practices. Your dealings with third parties are solely between you and them. We also use third-party providers (e.g., hosting, analytics) to deliver the Services; see our Privacy Policy for details.Subscriptions, billing, and refunds
DutyWire may offer subscription-based features or in-app purchases (“Subscriptions”).
9.1 Billing through app stores: Subscriptions are billed through the relevant app store (e.g., Apple App Store). App store terms govern billing, payment, refunds, and cancellations. We do not collect or store your full payment card details.
9.2 Auto-renewal: Unless stated otherwise, Subscriptions auto-renew each period until you cancel. You authorize the app store to charge the fee (and taxes) to your payment method.
9.3 Managing and canceling: You can cancel anytime; cancellation takes effect at the end of the current period. On iOS, manage via Settings > Apple ID > Subscriptions. We cannot cancel iOS subscriptions on your behalf.
9.4 Refunds: Refunds are handled by the app store under its policies. Use the app store’s “Report a Problem” or receipt instructions.
9.5 Price changes and trials: Prices may change; notice will be provided where required. Trials/promotions convert to the regular price if not canceled before the period ends.
9.6 Pro features: DutyWire Pro unlocks premium features (e.g., unlimited records/folders/attachments, calendar reminders/recurrence, exports, and wellness limits). Features and pricing may change; billing and refunds are handled by the app store.Intellectual property
The Services and all content, features, and functionality are owned by DutyWire or licensors and protected by law. “DutyWire” and related marks are trademarks of DutyWire. Except for the limited license in Section 4, no rights are granted to you. All rights are reserved.Feedback
If you provide feedback or suggestions, we may use them without restriction or obligation to you, and you are not entitled to compensation or ownership.Changes to the Services
We may modify, update, or discontinue all or part of the Services at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation.Termination
We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or law, pose a risk, or if we discontinue the Services. You may stop using the Services anytime and request deletion of your account and personal data as described in our Privacy Policy. Upon termination, your right to use the Services ends; provisions that should survive will remain in effect.Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, DUTYWIRE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted, secure, or error-free operation, or the accuracy or reliability of content.Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DUTYWIRE AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, THIRD-PARTY CONDUCT OR CONTENT, CONTENT OBTAINED FROM THE SERVICES, OR UNAUTHORIZED ACCESS/USE. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU FOR THE SERVICES IN THE PRIOR 12 MONTHS OR (B) USD $100. Some jurisdictions do not allow certain limitations; in those cases, limits apply to the fullest extent permitted.Indemnification
You agree to indemnify and hold harmless DutyWire and its owners, officers, employees, and affiliates from claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising from your use of the Services, your User Content, your violation of these Terms, or your violation of any rights of another.Governing law and dispute resolution
These Terms are governed by the laws of the State of New Jersey and the United States, without regard to conflict of law principles. Disputes will be brought exclusively in the state or federal courts located in New Jersey, and you consent to their jurisdiction.Changes to these Terms
We may update these Terms from time to time. We will revise the “Last updated” date and may provide additional notice for material changes. Continued use after changes become effective means you accept them; if you do not agree, stop using the Services.Account deletion and retention
You can delete your account within the app (Profile tab → Settings/Account Settings → Delete Account) or by emailing support@dutywire.com. Deletion stops future access; residual copies may persist in backups for a limited time as described in our Privacy Policy.Notifications
